These Terms of Use govern access to and use of CPlay Social HUB. By using the platform, the user acknowledges and agrees to these terms, the Privacy Policy, and the Cookies Policy.
This document is part of the platform's data governance and usage framework, aligned with the Brazilian General Data Protection Law (LGPD - Law No. 13,709/2018) and the European Union General Data Protection Regulation (GDPR - Regulation (EU) 2016/679), according to processing context and data subject location.
Use of the platform in production environments should occur only after legal validation of the current version of this document and related policies.
1. Controller Identification
Controller: CPLAY LTDA (trade name: CPLAY), a private legal entity registered under CNPJ No. 60.661.726/0001-05, headquartered at Avenida Alvaro Otacilio, No. 3731, Sala 610, Cond. Jatiuca Trade Residence, Jatiuca, Maceio/AL, ZIP 57035-180, Brazil.
Legal nature: Limited Liability Business Company (headquarters). Registration status: active.

2. Purpose and Scope
The platform allows eligible account connection, content synchronization, and publication widget display in embedded environments, as well as related administrative resources.
3. Service and Advertising Modalities
The service may operate under different modalities: free plan funded by contextual advertising, paid ad-free plan, and third-party sponsored modality.
In the free modality, contextual advertising is part of the core service delivery. Personalized advertising and profiling technologies, when applicable, depend on legal basis and specific consent according to the Privacy Policy and Cookies Policy.
Refusal of non-essential technologies does not prevent use of essential service features, subject to the commercial rules of the contracted modality.
4. Eligibility and Access
Users must provide truthful information, keep credentials secure, and comply with access rules established for each operational profile.
5. User Responsibilities
Users are responsible for the accuracy of provided information, proper credential usage, compliance with third-party rules (including Meta/Instagram), and legality of managed content and integrations.
When the widget is embedded in a third-party website, portal, or app, the domain owner must maintain its own Privacy Policy and Cookies Policy, include reference to CPlay widget usage, and implement the applicable consent/cookies mechanism (CMP or banner), under LGPD and, where applicable, GDPR.
Collection, management, and recording of end-visitor consent on third-party domains are the responsibility of that domain's operator/controller, including for non-essential technologies and personalized advertising.
6. Security and Integrity
Technical and organizational security measures are applied to protect data and platform operation. Users must collaborate with secure access and usage practices.
7. Availability
The service may vary due to maintenance, incidents, or third-party API unavailability, without guarantee of uninterrupted operation or absence of faults.
8. Intellectual Property
Platform trademarks, visual identity, code, and institutional content are protected by applicable law. Unauthorized use is prohibited.
9. Limitation of Liability
Within legal limits, CPlay is not liable for outages caused by third parties, user misuse of the platform, or violations resulting from compromised credentials under user responsibility.
10. Changes and Effectiveness
These terms may be updated for legal, technical, or operational reasons. The current version remains published with effective date and version control.
11. Contact Channel
Requests related to these terms, privacy, and exercise of rights must be sent to CPlay's official channel. Contact details must be kept up to date by the responsible team.
Personal data subject requests will be handled under LGPD and the current Privacy Policy, also observing GDPR where applicable.
12. Governing Law and Jurisdiction
Applicable law is defined by contract and/or current corporate policy, with competent jurisdiction indicated by CPlay legal counsel.
